These Terms & Conditions (“Terms”) govern your use of www.buddsteel.com (the “Website”) and the
purchase of products or services from Buddsteel Architectural Products Ltd. (“Buddsteel”, “we”,
“us” or “our”).
By accessing this Website, submitting an order, or purchasing products or services from Buddsteel, you
agree to these Terms. If you do not agree with these Terms, please do not use the Website or place an
order.
Nothing in these Terms is intended to limit any rights or remedies that cannot legally be excluded or
limited under applicable Canadian or provincial law.
1. Website Use
The information on this Website is provided for general information and purchasing purposes. We make
reasonable efforts to keep product information, descriptions, specifications, images, pricing and
availability accurate and current; however, errors or omissions may occur.
Buddsteel reserves the right to correct errors, update information, modify or discontinue products or
services, or make changes to the Website at any time without prior notice.
We do not guarantee that the Website will always be available, uninterrupted, secure or free from
errors, viruses or other harmful components.
You agree not to misuse the Website, interfere with its operation, attempt unauthorized access,
introduce malicious software, collect information improperly, or use the Website for any unlawful
purpose.
2. Product Information & Images
We make reasonable efforts to accurately display our products. However, photographs, digital images,
samples and screen displays may not exactly represent the appearance of the finished product.
Actual colour, texture, grain, finish, dimensions and appearance may vary due to manufacturing
tolerances, material characteristics, lighting, photography and differences between computer or mobile
displays.
Natural materials such as wood and slate may have variations in colour, grain, texture and markings.
These natural variations are not considered defects.
Custom-manufactured and personalized products may also have minor variations resulting from the
manufacturing, cutting, engraving or finishing process.
Product specifications and designs may be changed from time to time without notice provided the
change does not materially alter an accepted order.
3. Orders & Acceptance
Submitting an order through the Website does not guarantee acceptance by Buddsteel.
We reserve the right, where permitted by law, to refuse or cancel an order due to:
• product unavailability;
• incorrect pricing or product information;
• suspected fraud or unauthorized payment;
• inability to manufacture or supply the requested product;
• errors in customization information;
• shipping or delivery restrictions; or
• other reasonable business considerations.
If we cancel an order after payment has been received, we will refund the applicable amount paid for
the cancelled portion of the order.
Customers are responsible for reviewing all order information carefully before submitting an order.
4. Custom & Personalized Products
Many Buddsteel products are custom manufactured, engraved or personalized specifically for the
customer.
The customer is responsible for ensuring that all names, dates, wording, measurements, quantities,
colours, artwork, logos, photographs, specifications and other information submitted with an order are
accurate.
Where Buddsteel provides a proof for approval, it is the customer’s responsibility to carefully review
the entire proof. Approval of a proof constitutes authorization for Buddsteel to manufacture the
product as shown.
Once production has started, custom or personalized orders generally cannot be changed or cancelled.
Buddsteel is not responsible for spelling errors, incorrect dates, incorrect measurements, design choices
or other errors that were supplied or approved by the customer.
We may make minor adjustments to the size, positioning, spacing or layout of artwork or text when
reasonably necessary for manufacturing or engraving.
5. Customer-Supplied Artwork & Intellectual Property
By providing Buddsteel with photographs, logos, trademarks, artwork, designs, text or other materials
for reproduction, engraving, printing or manufacturing, you confirm that you own the material or have
permission to use and reproduce it for the requested purpose.
You authorize Buddsteel to use and reproduce the supplied material solely as reasonably necessary to
complete your order.You are responsible for claims arising from materials you provide to us where you did not have the
necessary rights or permission to use those materials.
Buddsteel reserves the right to refuse any artwork, wording or design that we reasonably believe may
infringe another person’s rights, violate applicable law, or otherwise be inappropriate for production.
6. Pricing, Taxes & Payment
Unless otherwise stated, prices displayed on the Website are in Canadian dollars (CAD).
Applicable taxes and shipping or delivery charges will be shown or calculated as required during the
ordering process.
We make reasonable efforts to ensure pricing is accurate. If a pricing error occurs, we may correct the
error and, where permitted by law, offer you the opportunity to proceed at the corrected price or cancel
the affected order for a refund.
Payment must be made using one of the payment methods accepted on the Website. You represent that
you are authorized to use the payment method provided.
Buddsteel does not guarantee that every payment transaction will be approved by the applicable
payment processor or financial institution.
7. Shipping & Delivery
Delivery dates and shipping times are estimates unless Buddsteel expressly agrees otherwise in writing.
Buddsteel will make reasonable efforts to manufacture and ship orders within the estimated timeframe.
However, delays may occur because of carrier delays, material shortages, weather, labour disruptions,
equipment problems, supply-chain interruptions, acts of government, emergencies or other
circumstances beyond our reasonable control.
To the extent permitted by applicable law, Buddsteel is not responsible for losses resulting solely from
shipping or delivery delays outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address.
Customers should inspect shipments promptly upon delivery and notify Buddsteel as soon as
reasonably possible of visible shipping damage, shortages or incorrect products. Photographs of the
packaging and product may be required to process a shipping or damage claim.
We will make reasonable efforts to assist customers with legitimate carrier claims.
8. Returns, Exchanges & Cancellations
Standard Products
Returns of eligible standard products may be accepted within the return period stated by Buddsteel,
provided that:• prior return authorization has been obtained from Buddsteel;
• the product is unused and in resalable condition;
• proof of purchase is provided; and
• the product is not a custom, personalized, clearance or otherwise non-returnable item.
Unless otherwise agreed in writing, approved standard-product returns are subject to a 20% restocking
fee.
Return shipping costs are the customer’s responsibility unless the product was supplied incorrectly by
Buddsteel or is confirmed to be defective.
Custom & Personalized Products
Custom-manufactured, custom-cut, specially ordered, engraved or personalized products are final sale
and non-refundable, except where the product is defective, damaged, does not conform to the
accepted order, or where a return or other remedy is required by applicable law.
Clearance Products
Products identified as Final Sale or Final Clearance cannot be returned or exchanged except where
required by applicable law.
Before returning any product, please contact Buddsteel to obtain return authorization and shipping
instructions.
9. Defective, Damaged or Incorrect Products
If you believe you have received a defective, damaged or incorrect product, please contact Buddsteel
promptly with your order information and, where appropriate, photographs showing the issue.
After reviewing the claim, Buddsteel may, as appropriate and subject to applicable law:
• repair the product;
• replace the affected product or component;
• provide replacement parts;
• issue a refund or credit; or
• provide another reasonable remedy.
No product should be returned without prior authorization from Buddsteel.
10. Product Installation, Use & Safety
Products must be installed, assembled, maintained and used appropriately and for their intended
purpose.
Where professional installation, proper anchoring, site measurements, structural support or compliance
with applicable building codes is required, it is the customer’s responsibility to ensure that
appropriately qualified persons perform the work unless Buddsteel has specifically contracted to
provide those services.Unless Buddsteel performed or expressly approved the installation, Buddsteel is not responsible for
damage, failure, injury or loss caused by improper installation, incorrect measurements supplied by the
customer, unauthorized modification, misuse, abuse, improper maintenance, unsuitable site conditions
or use of a product for a purpose for which it was not designed.
Customers and installers are responsible for determining whether a product is suitable for the particular
application and installation conditions.
11. Warranties
Any specific written warranty supplied by Buddsteel with a product will apply according to its stated
terms.
Except for warranties expressly provided by Buddsteel and warranties or conditions that cannot legally
be excluded, products and Website content are provided without additional representations, warranties
or conditions, whether express or implied, to the maximum extent permitted by applicable law.
Normal wear and tear, cosmetic changes from ordinary use, natural material variations, misuse, abuse,
vandalism, improper installation, improper maintenance and unauthorized alterations are not
considered manufacturing defects unless otherwise stated in an applicable written warranty.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Buddsteel Architectural Products Ltd., its
directors, officers, employees and agents will not be liable for indirect, incidental, special, punitive or
consequential damages, including loss of profits, revenue, business opportunities, data or use, arising
from or relating to:
• use of or inability to use this Website;
• reliance on Website information;
• delays outside Buddsteel’s reasonable control;
• misuse or improper installation of products;
• customer-supplied specifications, measurements, artwork or information; or
• products or services supplied by independent third parties.
Where liability cannot legally be excluded, Buddsteel’s liability will be limited only to the extent
permitted by applicable law.
Nothing in these Terms excludes or limits liability or customer rights that cannot legally be excluded or
limited.

professional advice.Customers, contractors, architects and installers are responsible for verifying specifications,
measurements, code requirements and suitability before ordering or installing products where these

Buddsteel does not control these third-party websites and is not responsible for their content, security,
availability, privacy practices, products or services.
Accessing a third-party website is at the user’s discretion and is subject to that third party’s terms and

Unless otherwise stated, the Website and its content, including photographs, graphics, product designs,
text, logos, drawings and other materials created by Buddsteel, are owned by or licensed to Buddsteel
Architectural Products Ltd. and are protected by applicable intellectual-property laws.
Website content may be viewed or printed for personal or legitimate purchasing purposes but may not
be copied, reproduced, modified, distributed or commercially used without Buddsteel’s prior written

severe weather, fire, flood, labour disputes, transportation interruptions, supply shortages, equipment
failures, government actions, public emergencies or similar events.

Buddsteel may update these Terms from time to time.
Changes will be posted on this page with an updated revision date. Changes will apply prospectively
and will not alter the terms of an order already accepted by Buddsteel except where required by law or
agreed with the customer.
20. Severability & Waiver
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be
limited or severed to the extent necessary, and the remaining provisions will continue in effect.
If Buddsteel does not immediately enforce a provision of these Terms, that does not constitute a waiver
of our right to enforce that provision later.
21. Governing Law
These Terms and transactions with Buddsteel are governed by the laws of the Province of Ontario and
the applicable federal laws of Canada, subject to any mandatory consumer-protection laws that may
apply.
All transactions are conducted in Canadian dollars unless otherwise expressly stated.
